Moving to Portugal

Swiss expat tax in Portugal

GuideLaw as at 19 October 20264 min read

A Swiss occupational pension for past private-sector employment is taxable only in Portugal when paid to a Portuguese resident (under the Switzerland-Portugal convention). That includes a lump-sum withdrawal (as covered by the treaty’s Additional Protocol), and Swiss source tax withheld from it is refundable on a claim to the canton where the pension institution is based, with the Portuguese tax authority confirming treaty residence and its knowledge of the payment.

Swiss pensions and Portuguese tax residence

The tax treatment of a Swiss pension depends on the type of pension, treaty residence and whether it is paid periodically or as a lump sum.

What changes when you move from Switzerland to Portugal

Formal deregistration, the last wealth-tax period, and any pension withdrawal should be checked before the move rather than assumed from a generic exit-tax rule.

The real planning happens around the second and third pillars. A lump-sum withdrawal triggers a Swiss source tax whose rate depends on where the pension foundation sits, and Portugal can treat the lump sum differently from a regular pension. Get those moving parts in the wrong order and a lump sum can be taxed twice.

How the treaty between Switzerland and Portugal allocates your income

Switzerland and Portugal tax under a treaty in force, with relief by credit or exemption. As a broad map for someone now resident in Portugal:

Income typeWhere it is taxedNotes
Swiss AVS or AHV first-pillar pensionPortugal (residence)No Swiss source tax on the current pension.
Swiss 2nd Pillar (Occupational) and 3rd Pillar Private PensionPortugal (residence)For private-sector provision; lump sums are a special case (below).
Swiss public-service pensionGenerally Switzerland, subject to the treaty residence and nationality exception.
EmploymentUsually the country where the work is performed, subject to treaty rulesWorkdays in Switzerland may also be taxed there. Check the short-stay exception: days present, employer residence and which establishment bears the pay.
Dividends and InterestSwiss withholding may apply; Portuguese treatment depends on the applicable rulesEligible treaty claims can recover excess Swiss withholding. Any Portuguese credit is subject to limits.
Private portfolio gainsGenerally PortugalProperty-rich shares and assets connected with a Swiss business or establishment require separate analysis.
Swiss Real Estate (Rent and Gains)Switzerland (where the property is)Portugal taxes too and gives relief.

The treaty permits Switzerland to tax gains on shares deriving more than 50% of their value, directly or indirectly, from Swiss immovable property. Whether tax is actually due also depends on Swiss domestic law.

Swiss pension capital: tax, refund evidence and timing

IssueWhat to check
Swiss source taxIdentify the canton of the paying pension institution and obtain its tax statement. Private and public schemes can have different treaty results.
Refund claimTreaty relief is not automatic. The ESTV Q-IS procedure requires certification from the residence-state authority and its acknowledgement of the capital payment, followed by submission to the paying canton with supporting documents. This is not a universal requirement to prove Portuguese tax was paid.
DeadlineZürich states that a pension-capital refund must be requested within three years of payment.
Portuguese treatmentPreserve contributions, employment and transfer history. A lump sum and a periodic pension can have different taxable amounts or categories.

The mandatory occupational portion can remain restricted on a move to an EU country.

Pensions and why IFICI does not help retirees

Under IFICI, the regime that replaced NHR, foreign pensions are not exempt and are taxed at normal progressive rates. The old NHR flat pension rate is closed to new arrivals, and most retirees do not qualify for IFICI in any case.

Swiss withholding tax and reclaims

Swiss withholding can apply to covered dividends and interest; not every interest payment is subject to it. An eligible treaty resident may reclaim withholding above the applicable treaty limit, subject to the claim conditions and deadline.

Where Portugal taxes the income, any foreign-tax credit is limited by Portuguese law and the treaty and cannot exceed the Portuguese tax attributable to that income. Excess Swiss withholding may need to be reclaimed in Switzerland.

Coordinating the Swiss tax office and Finanças

Keeping Swiss property, Swiss investments, or Swiss pensions usually means a limited Swiss filing alongside Portuguese filing, with the treaty deciding who taxes what and Portugal giving relief.

Frequently asked questions

Which Swiss tax issues need checking before I leave?

The departure review covers your canton and commune, formal deregistration date, final wealth-tax period and any pension withdrawal.

How is my Swiss pension taxed in Portugal?

Under the treaty, your AVS state pension and your private-sector second and third-pillar pensions are generally taxable in Portugal as your country of residence, at normal progressive rates, because IFICI does not exempt foreign pensions. A Swiss public-service pension is treated differently and can remain taxable in Switzerland.

What happens to a lump-sum pension withdrawal?

A Swiss pension lump sum can be subject to source tax in the paying institution’s canton. Any treaty refund depends on the pension and recipient’s status. Portugal must separately classify the payment and its taxable amount.

Does IFICI cover my Swiss pension?

No. IFICI, the regime that replaced NHR, does not exempt foreign pensions; where Portugal taxes a Swiss pension it does so at standard progressive rates.

Can I reclaim Swiss withholding tax on dividends and interest?

An eligible treaty resident may reclaim Swiss withholding above the applicable treaty limit, subject to the claim conditions and deadline.
