A South African pension for past employment paid to a resident of Portugal is taxable only in Portugal under the past-employment pension rule in the South Africa-Portugal convention, unless it is paid for government service. Both states may tax an annuity bought from a South African insurer for a lump sum, South Africa at up to 12% of the income portion above USD 10,000 a year.

Departure steps, retirement interests, and treaty allocation need to line up before capital moves or either side files.

## Why South Africans in Portugal face exchange control, exit tax, and treaty gaps

First, South Africa's exchange control regulations can restrict how much capital you can move offshore, and the old "financial emigration" language has been replaced by a tax-residency cessation process with SARS plus exchange-control administration through authorised dealers. Second, ceasing South African tax residency triggers a departure-related capital-gains deemed disposal on certain worldwide assets, although South African immovable property and retirement-fund interests are carved out of it.

Third, the South Africa-Portugal DTA (Double Taxation Agreement) must be matched to the particular pension, income and asset rather than inferred from another country’s treaty. South Africa moved to a residence-based tax system in 2001. South African tax residents are taxed on worldwide income.

When you cease to be a South African tax resident under the ordinary-residence or physical-presence rules, or under the DTA, you move to source-based taxation; notifying SARS (South African Revenue Service) reports that change. SARS then taxes only South African-sourced income: rental income from SA property, SA dividends (subject to dividends withholding tax), and SA employment income. Retirement fund withdrawals are subject to specific exit rules.

Portugal considers your worldwide income during the Portuguese resident period, subject to the treaty and any applicable exemption. The DTA between the two countries allocates taxing rights and provides credit mechanisms. The DTA does not override exchange control, does not eliminate the departure-related capital-gains charge on the assets that charge covers, and does not remove the administrative steps for ceasing SA tax residency.

## How the South Africa-Portugal DTA allocates your income

Each income type is allocated to one or both countries.

### Employment income

If you work in Portugal for a Portuguese employer, Portugal taxes the salary. If you work remotely for a South African employer, the physical location of work determines the allocation.

The DTA's employment article applies the standard 183-day test for short-term assignments.

### South African pensions and retirement annuities

Pension fund and provident fund payments to a Portuguese resident for past employment fall under the DTA’s past-employment pension rule and are taxable only in Portugal; a pension for South African government service instead follows the government-service pension rule and is taxable only in South Africa unless the recipient is resident in, and a national of, Portugal.

Retirement annuity (RA) payments are usually not paid in consideration of past employment: an annuity the individual bought from a South African insurer for a lump sum falls under the purchased-annuity rule, which lets South Africa tax it at up to 12% of the income portion above USD 10,000 a year, and other RA payments fall under the other-income rule, taxable only in Portugal.

South Africa may apply withholding tax on lump-sum withdrawals from retirement funds.

### Retirement funds on emigration

Retirement-fund interests are carved out of the exit-tax charge, so ceasing residency does not trigger a deemed withdrawal. A payment can trigger South African tax under the rules for that benefit, subject to treaty relief. Qualifying lump sums use the retirement or withdrawal tables; periodic pensions or annuities can follow normal income-tax rules. A non-resident generally cannot access the full retirement annuity until completing three consecutive years of non-residence.

### Dividends

Treaty dividend rates depend on shareholding thresholds, beneficial-ownership conditions, and the exact treaty article. You may need to apply for the reduced rate through the paying agent. Under the ordinary Portuguese rules, Portugal taxes the gross dividend and credits eligible South African tax within Portuguese and treaty limits. Qualifying foreign income can be exempt under IFICI, subject to its category, source and jurisdiction conditions; existing NHR rights follow their own rules. IFICI does not exempt pensions.

### Interest

South African-source interest paid to foreign persons can be subject to withholding tax unless an exemption or a reduced treaty rate applies.

### Capital gains

Gains on South African real property are taxable in both countries. Gains on SA securities are generally taxable only in Portugal.

However, the SA exit charge may have already applied a CGT ([capital gains tax](/guides/capital-gains-tax-portugal/)) event on emigration. After emigration, Portugal may tax the gain as residence state. The South African exit value does not automatically reset Portugal’s acquisition basis.

### Rental income from SA property

Taxable in both countries. South Africa taxes rental income from SA property under non-resident provisions.

Portugal generally taxes net Category F rental income after eligible expenses and may grant double-tax relief where conditions are met.

## Ceasing South African tax residency: SARS and Reserve Bank requirements

1. ### Confirm you meet the "ceasing" criteria

Identify the legal basis and effective date of cessation. Ordinary residence turns on whether South Africa remains your real home, assessed from intentions and objective facts. Someone resident only under the physical-presence test ceases to be resident after a continuous period of at least 330 full days outside South Africa, with effect from the day of departure. Exclusive Portuguese residence under the DTA can also exclude South African residence, even where a domestic residence test would otherwise apply.

The physical-presence test applies only to someone who is not ordinarily resident at any time during the tax year (year of assessment). It requires physical presence in South Africa for more than 91 days in aggregate in that tax year, more than 91 days in aggregate in each of the five preceding tax years, and more than 915 days in aggregate across those five preceding tax years.
2. ### Notify SARS

File a declaration of ceasing to be a tax resident with SARS.

SARS may request supporting documentation: proof of Portuguese residency, lease agreements, visa, and employment contracts.
3. ### Complete the SARB/authorised-dealer process

Exchange-control administration is handled through your authorised dealer (your bank).

Your SA bank accounts are reclassified from resident to non-resident status.
4. ### Obtain tax compliance confirmation for transfers

SARS tax-compliance procedures (including TCS/PIN processes used for foreign-investment transfers) are required by your bank for larger capital transfers.

Processing times vary from weeks to months.
5. ### File your final SA resident return

Your final return covers 1 March to your date of ceasing residency. Report worldwide income for this period. Any departure-related capital-gains charge is assessed on this return.

## Managing SA retirement funds and investments from Portugal

### Retirement annuities (RAs) and preservation funds

You can leave your RA or preservation fund invested in South Africa after ceasing residency.

Compare the available withdrawal dates after classifying the payment; lower other income can matter where progressive Portuguese taxation applies.

### Living annuities

For a living annuity, establish whether the payment follows the treaty’s past-employment pension rule, its purchased-annuity provision or another treaty rule. South African withholding may require relief at source or a refund if the treaty removes South Africa’s taxing right.

SA unit trusts and share portfolios: capital gains on SA securities after ceasing residency are generally taxable only in Portugal.

### SA property

Rental income is taxable in both countries. On sale, South Africa applies non-resident CGT provisions. Where the sale price exceeds R2 million, the purchaser generally withholds part of the price for SARS; a directive can reduce or remove the withholding.

Under the ordinary Portuguese rules, Portugal taxes the gain and credits eligible South African capital-gains tax within the applicable limits. Qualifying foreign gains can be exempt under IFICI; preserved NHR rights follow their own rules. For how Portugal handles property gains specifically, see [capital gains tax in Portugal](/guides/capital-gains-tax-portugal/).

### Exchange control considerations

Transferring capital from SA to Portugal requires compliance with SARB regulations. Transfers above the discretionary allowance require the applicable SARS tax-compliance process.

## Common mistakes South African expats make in Portugal

- Not reporting the change to SARS. Even where tax residence has ended under the relevant tests, outdated SARS records can lead to assessments or requests that need correcting.
- Assuming a retirement-fund exit charge that does not exist. Tax arises only on actual withdrawal.
- Paying full South African dividends withholding tax.
- Missing the exchange-control process. Attempting to transfer large sums without SARS clearance can cause delays and penalties, so start the TCC process before funds are needed in Portugal.
- Claiming a credit before establishing treaty allocation. Distinguish eligible Portuguese credit from withholding that must be relieved or refunded in South Africa. Portuguese foreign-tax-credit limits still apply; tax withheld is not automatically tax creditable in Portugal.

## Cessation and exchange-control workflow (practical)

South African relocation cases run on two parallel tracks: ceasing tax residency with SARS, and exchange-control administration through authorised dealers.

Do not run these two processes independently. Misalignment is a common cause of delays and blocked transfers.

## Retirement funds and transfer evidence pack

For retirement and investment transfers, maintain a structured audit file:

- Fund statements and policy terms.
- Tax treatment memos and withholding records.
- Bank transfer documents and compliance confirmations.
- Portuguese receipt records and classification notes.

## Frequently asked questions

### Does South Africa tax me after I move to Portugal?

Moving physically does not by itself decide South African tax residence. After cessation, South African-source income and particular retirement or exit-tax items can remain taxable; Portugal considers worldwide income during its resident period, with applicable treaty relief.

### Does ceasing South African tax residency trigger an exit charge on my retirement funds?

No. Ceasing South African tax residency does not trigger a deemed withdrawal of your retirement interests. Retirement annuities, pension, provident, and preservation funds are carved out of the exit-tax charge. South African tax can arise when a benefit is paid, subject to treaty relief.

### How do I transfer money from South Africa to Portugal?

Through your authorised dealer (SA bank) in compliance with SARB exchange-control regulations.

### Are my South African dividends taxed in Portugal?

Under the ordinary Portuguese rules, yes, with a credit for eligible South African tax within Portuguese and treaty limits. Qualifying foreign dividends can be exempt under IFICI; an existing NHR position follows its own rules. Exemption does not remove applicable Portuguese reporting obligations.

### Can South Africans qualify for IFICI in Portugal?

South Africans working in technology, engineering, data science, or research roles may qualify. Our [IFICI guide](/guides/ifici/) sets out the conditions and the 15 January 2027 registration deadline for 2026 arrivals.
